Guidance on proving discrimination

Article Abstract:

An issue concerning sex discrimination is studied with reference to the case Shamoon v Chief Constable of the Royal Ulster Constabulary. In the case, the House of Lords holds that an employee is subjected to detrimental treatment even where he or she does not miss pay or status.

The revised guidance issued by Acas on the implementation of the new Regulations on religion or belief and on sexual orientation are elaborated. The application of genuine occupational requirement (GOR) exceptions is discussed.
