Article Abstract:
Developments in four cases referred to the European Court of Justice (ECJ) by courts in Germany, the UK and the Netherlands to clarify the ECJ's Barber Judgment are reported. The Barber Judgment stipulates that each element of remuneration must be the same for male and female employees and applies to occupational benefits and retirement ages. It, however, runs counter to an EC directive which allows different retirement ages in occupational pension plans so long as these correspond to the retirement ages in national social security.

German companies planning to downsize their workforces to preserve corporate competitiveness should implement bridging-income schemes that will provide retirement benefits to employees who will be laid off. These schemes, which will cover the period from the time an employee is terminated up to his approximate retirement age, could help employers avoid unfriendly severance disputes. They also compensate for the shortcomings of the government's social security system.
