Issues are presented concerning the benefits which cash balance plans bring to business enterprises who wish to motivate and retain their best performing employees. The need to modernize pension laws is discussed.

The Employee Retirement Income Security Act (ERISA) has been viewed by many plan sponsors as a bane to the existence of defined benefit plans, but one pension fund does not think so. The Central Pension Fund (CPF) of the International Union of Operating Engineers and Participating Employers has not only survived, but more importantly, thrived under ERISA. Specifically, administrative burdens associated with the act were accommodated while costs were kept down by the CPF due to ERISA's provisions.
