Curtis Norman's job as a shuttle car operator in the West Virginia coal mines ended when he suffered a back injury on Aug 12, 1982. His application for a disability pension was granted by the United Mine Workers of America 1974 Pension Plan only for the period starting Nov 1, 1987 onwards, but not for the period Aug 14, 1982-Oct 31, 1987. The reason cited for the denial was that Norman's condition during that time was not the result of a mining accident. The court ruled that the trustees abused their discretion because they denied the application without substantial evidence.

On the other hand, laws governing the income tax responsibility of US expatriates who derived benefits from foreign qualified plans and foreign expatriates who benefited from their respective countries' plans are vague.
