Article Abstract:
A study was conducted to show how the cumulation provision in GATT/WTO rules makes anti-dumping (AD) an anti-competitive law. The market shares of nations in AD petitions were tallied and analyzed. Results indicated that the country-specific nature of AD protection hindered significantly the effectiveness of AD. Antidumping had become a protective status resulting from increases in the number of cases filed regarding the nature of the cumulation provision.
