Article Abstract:

UK management contractors Mowlem commenced arbitration proceedings against Carlton Gate in 1989. Mowlem was awarded 12 million pounds sterling but received nothing when Carlton Gate went into receivership. Mowlem decided to commence proceedings against the other joinnt venture parties, Eagle Star Insurance and the architects PRP (Phippen Randall and Parkes) for breach of contract and conspiracy. Mowlem was allowed to proceed but was not allowed to imply that PRP procured a breach of Carlton Gate.

Bleak House sequel hits Percy Trentham

Article Abstract:

A legal wrangle developed between building contractor Percy Trentham and client Municipal Mutual over a design and build development in Farnborough, Hampshire, UK. The case was decided against Trentham, which subsequently sued seven defendants, including subcontractor Archital Luxfer. The court ruled that the subcontractor was not bound by an arbitrator's decision even though it had been invited to participate in the arbitration.
