Article Abstract:
Further provisions of the 1991 Planning and Compensation Act come into force in July 1992. These, added to the provisions already in operation, give councils new powers in planning matters. They will be able to issue breach of condition notices and injunctions to any person controlling the use of land, including contractors. The proposed European Directive on unfair terms in consumer contracts has been revised. The European law is to be much further reaching than present British law and is likely to be opposed by the UK government.

The practice of challenging public procurement contracts in Germany on the grounds of breach of European Union rules is examined. The potential for such challenges of tendering procedures of publicly funded contracts in the UK is assessed.
