Joint and several liability

Article Abstract:

The concept of joint and several liability, under which someone who suffers damage because of the actions of more than one other person can sue all or any of them, has a number of serious drawbacks, according to some observers. Most seriously, a defendant who has only been partly responsible for a problem could end up having to pay the full amount of damages. Others feel that the abolition of joint and several liability would create even more serious problems and may work to the disadvantage of the construction industry.
