Article Abstract:
The Netherlands building contract tendering practices have been found to be illegal by the European Commission, leading to a 14.85 million pounds fine for the industry. The practices involved contractors revealing bids to other bidders in order to arrange a suitable price while adding extra costs on tenders to meet the financial needs of those contractors who where unsuccessful. The building associations were fined because the European Commission claim the practice when against the common market ethics of trading rules.

It appears to be very common in the UK for manufacturers of plumbing and heating equipment to produce goods which are not fit for the purpose for which they are intended. Plastic piping, for example, frequently leaks, while plastic baths cannot be properly sealed to ceramic tiles. In many cases, tiles are of poor quality, and are sealed with plastic junction strip which soon discolours and looks unsightly. Modern radiator designs are often found to be faulty, requiring a great deal of remedial work.

Issues are presented concerning the limited opportunity which exists for the overturning of final settlements. The role of the adjudication process in the settlement of disputes is discussed.
