European Parliament deals e-commerce a blow

Article Abstract:

The e-commerce industry was dealt a severe blow when a European Parliament decided to shift jurisdiction in disputes between online seller and buyer from the country of origin to the country of destination. The ruling reversed a recommendation by the parliament's legal affairs committee approved in Sep 2000 that would have allowed companies to choose the jurisdiction provided they inform consumers in advance. It poses a major obstacle to small and mediium-sized businesses using online media since consumers can sue e-tailers in every EU member state.

E-commerce package approval expected

Article Abstract:

The European Parliament is expected to pass a legislation that calls for country of origin regulation of electronic commerce. The proposed legislation, however, allows for three exceptions, which could be critical. One gives country of destination control over contracts. The second gives country of destination the right to ban unsolicited e-mail. The third puts direct response television advertising under e-commerce regulations.
