Online marketers operating within the European Union (EU) face uncertainty over the wording of some provisions in the EU's new directive on electronic commerce. The directive particularly is not clear whether the country-of-destination or country-of-origin law should apply in resolving disputes in some situations. At the center of the confusion is the distinction the directive makes between offer and contract, with offer governed by country-of-origin law while contract does not.

The European Union directive on consumer data protection is expected to give a boost to Denmark's direct marketing (DM) industry once approved by the Danish parliament. The directive will loosen regulations that restrict the Danish DM industry, allowing, for example, the buying and renting of lists. Current Danish law only allows direct marketers to lift consumer names and addresses from the phone book.

Denmark's new data protection law has been lauded by local direct marketers because it would liberalize the list broker market. The new law, which was adapted from the European Union directive, will take effect on Jul 1, 2000. It will also call for the creation of a Danish Mail Preference Service where people who do not want to receive mail or other direct marketing pieces can register their name.
