Article Abstract:

Including withdrawal rights in irrevocable trusts is a tax planning technique with application to gift taxes. However, including such rights in trusts can bring complications extending even to adverse tax implications. Ways to handle such complications in drafting trusts are discussed.

Total return unitrusts are becoming more and more popular. They provide more flexibility than traditional trusts because TRUs do not require trustees to follow the Prudent Investor Rule. Some of the advantages and disadvantages of TRUs are discussed.
