The proposed budget of the United States President George W. Bush will shut down the Advanced Technology Program (ATP) of the National Institute of Standards and Technology, which funds research and development projects that will have commercial value but are not attractive for private investors. Small biotech startup firms will be badly affected as they depend on these funds for developing their technologies.

The draft guidelines introduced by the US National Institute of Health suggested that patents covering diagnostics should to be licensed on a nonexclusive basis. Based on anecdotal data the draft claims that academic and nonprofit institutions exclusively licensing genomic technologies will have negative effects on the quantity and quality of healthcare products and services.

James Rogan director of the US Patent and Trademark Office (USPTO) stepped down from his post but was praised for introducing initiatives to modernize the administration of the patent system and for launching a five year 21st century strategic plan to overhaul the US patent system that was under funded. John Dudas, former deputy director of the USPTO is replacing James Rogan.
