The Immigration service argues that he should go back to Cuba, while a Florida judge argues that he should stay. There have been demonstrations in Cuba calling for his return. There had been better understanding between Cubans in Miami and those in Cuba, with more contact, and a reliance on remittances from Cubans in the US. The boy's father wanted to go to Florida to fetch him, but the case has become a diplomatic issue, and Cuba's government wants him returned.
