Are independent counsels necessary?

Article Abstract:

The US Congress is debating the Independent Counsel Act. The indepedent counsel is able to use an unlimited budget, and tends to investigate people rather than crimes, so there is an incentive to carry out exhaustive investigations of people. There may be calls to limit the powers of special prosecutors, but there is a need to allow them enough power to be effective. There is no need for a statute for a special prosecutor, since political pressures mean that they have protection from being fired. There should be great care in the selection of special prosectors so that there is no suspicion about their motives.

The US impeachment process is continuing, with charges set out in draft articles. President Bill Clinton is accused of perjury, obstruction of justice, and abuse of power. The Judiciary Committee only has to approve a single article for a House vote, and a majority vote will mean a presidential trial in the US Senate. Clinton's supporters stress that the general public do not wish to see Clinton impeached, and that his misconduct does not affect his official presidential role.
