A common element to aggressive tax planning is the creation of a tax deduction without there being any real loss or expense. The decision of the court served as a warning to tax payers that they would be judged on the actions of their tax advisors and suffer penalties because of these actions.

Advice on three aspects of Australian tax law is presented. The issues covered in the article are defining a same business test, a review of the capital gains taxation system and the Income Tax Assessment Act 1936, Section 264.
